The European Commission published a consultation on the draft of the Standard contractual clauses. The document that the data privacy community has been expecting for quite a while.
Now, if your company is involved in the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679 (GDPR), this is something you should be interested in, in particular in the world of post-Schrems II.
It is a so-called EC implementing decision – directly applicable in all MSs –, so giving the Commission a relatively carte blanche to act on the limited scope of particular matter of data privacy, without control form the European Parliament or the Council. The SCCs are also limited to data transfers and can be included in a wider contract covering other, already existing or new trade relations.
The draft is open to consult until 10 December.
